LGPS: Appeal against the Ill-Health Retirement Decision
The Local Government Pension Scheme (LGPS) provides three levels of ill-health retirement benefits: Tier 1, Tier 2 and Tier 3. Further information can be found at the following link: Ill Health Retirement
Tier 1: The employee is likely to be permanently incapable of doing their normal employment due to ill-health and unlikely to be capable of gainful employment before the Normal Pension Age.
Tier 2: The employee is likely to be permanently incapable of doing their normal employment due to ill-health and unlikely to be capable of gainful employment within three years of leaving, but is likely to be capable of gainful employment before their Normal Pension Age.
Tier 3: The employee is likely to be permanently incapable of doing their normal employment due to ill-health and likely to be capable of gainful employment within three years of leave or before their Normal Pension Age, if it is earlier.
It is not uncommon for an ill-health retirement application to be unsuccessful or only partially successful, but an appeal process can be daunting.
If you wish to appeal against the recommendations of an independent registered medical practitioner (IRMP), you will be expected to provide further medical evidence to support your appeal. You can seek a medical report from your GP and/or hospital specialist for this purpose, but a comprehensive and specific occupational health report from an independent consultant occupational physician is likely to be more valuable to the success of your appeal.
